This petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking appointment of a sole arbitrator to adjudicate the disputes between the parties.

The case of the petitioner is that the petitioner had booked two adjoining commercial plots bearing Nos. E-37 and E-38 in a residential complex, namely Era Green World, situated at Sector-8, Palwal, Haryana, which was being developed by the respondent. Two Builder Buyer Agreements were executed on 24.09.2013.

Disputes having arisen between the parties the petitioner invoked the arbitration clause. The petitioner has thereafter filed the present petition.

The learned counsel for the respondent who has entered appearance very fairly submits that there is an Arbitration Clause and that he has no objection in case this court appoints a sole arbitrator to adjudicate the disputes between the parties without prejudice to the rights and contentions of the respondent.

Accordingly, I appoint Mr.Prem Kumar, Retd. Additional District & Sessions Judge, Delhi (Mobile No.9873176030) as the sole arbitrator to adjudicate the dispute between the parties. The arbitration shall take place under the aegis of Delhi International Arbitration Centre, New Delhi (in short 'The DIAC'). A copy of this order be sent to the DIAC and to the learned arbitrator.

The petition stands disposed of as above.
