% 12.10.2017 Vide order dated 15th April, 2017 defence of the petitioner has been struck off, since he failed to pay the cost of Rs.10,000/- and the litigation expenses. Learned counsel for the petitioner submits that petitioner has now arranged the funds and would pay the cost and the litigation expenses to the respondent before the trial court. In case defence is struck off, the petitioner would be prejudiced. Respondent's counsel has no objection in case A.K. PATHAK, J.
