% 13.05.2016 CO. APPL. 1742/2016 & CO. PET. 468/2015 This application has been moved by the petitioner seeking withdrawal of the instant petition on the ground that the matter has been settled on terms as set down in the settlement agreement executed between the parties on 22nd March, 2016. A copy of the said agreement has also been annexed to this application.

Issue notice.

Proxy counsel for the respondent appears and states that he has been authorized to accept notice in this application and also to approbate the settlement agreement dated 22nd March, 2016, which has been duly executed between his client and the petitioner, and that the amount of Rs. 86,75,000/- contemplated in this agreement has been duly paid to the petitioner in full and final settlement of all disputes with regard to the subject matter of the instant petition.

Counsel for the petitioner/applicant affirms this fact. Counsel for the petitioner states that since his client has received the entire consideration in terms of the agreement, he does not wish to proceed with this matter any further.

Consequently, the petition, along with the accompanying application, stands disposed of in terms of the aforesaid settlement. The next date of 30th May, 2016 stands cancelled. SUDERSHAN KUMAR MISRA, J MAY 13, 2016/radhika
