By this transfer petition, the petitioners seek transfer of execution petition bearing No.125/2017 pending in the Court of Sh. S.S. Malhotra, learned Presiding Officer-MACT, North Rohini, Delhi to the competent Court of jurisdiction in Central District Tis Hazari Courts, Delhi.

Learned counsel for the petitioners states that the petitioners are resident of Sant Nagar Burari, Delhi and the property in question, which is the subject matter of execution is also situated at Burari.

Ms. Deboshree Mukherjee counsel appearing for Ms. Moulshree Shukla, Advocate, on instructions, submits that she T.R.P 163/2018

has no objection if the execution is transferred to any competent court of jurisdiction in Central District, Tis Hazari Courts, Delhi.

In the circumstances, the execution petition bearing No.125/2017 pending in the Court of Sh. S.S. Malhotra, learned Presiding Officer-MACT, North Rohini, Delhi is withdrawn from the said Court and is transferred to the learned District Judge, Central District, Tis Hazari Courts, Delhi who may assign the matter to any competent Court under his jurisdiction to decide the matter in accordance with law.

The petition along with pending application, being CM No.35163/2018 is disposed of.
