O R D E R

1. This is a petition filed by the Petitioner under Section 29A (5) of the Arbitration and Conciliation Act, 1996 („Act‟) seeking extension of time for completing the arbitration proceeding.

2. There is no objection as far as the extension of time is concerned. The Court accordingly directs that the time for making the Award in the ongoing arbitration proceedings shall extended by six months from today.

3. The further prayer is that the statement of defence of the Petitioner, which was not taken on record by the learned sole Arbitrator, should be permitted to be filed. Learned counsel for the Respondent opposes the prayer stating that several opportunities have already been granted to the Petitioner for that purpose.

4. Subject to the Petitioner paying the Respondent a sum of Rs. 5,000 as costs within ten days from today and placing before the learned sole Arbitrator proof of payment of such costs, the Petitioner is permitted to file its statement of defence in the arbitration on or before 3rd December 2016.
