% 18.04.2017 The petitioner has preferred the present petition to assail the order dated 08.09.2015 passed by the Central Administrative Tribunal, Principal Bench, New Delhi in O.A.No.4233/2012 whereby the said original application preferred by the petitioner to seek parity with Laboratory Assistants of Safdarjung Hospital has been dismissed. During the course of the submissions, learned counsel for the petitioner has placed reliance on the Office Memorandum dated 06.10.1997 issued by the Ministry of Health and Family Welfare as also the notification dated 06.01.1988 issued by the said Ministry. These documents were not relied before the Tribunal. In these circumstances, the petitioner seeks leave to withdraw the petition and again approach the tribunal. The petition is accordingly dismissed as withdrawn with liberty to the petitioner to approach the tribunal afresh. The impugned order

shall not come in the way of the petitioner in raising his grievance in the light of the aforesaid documents.
