On 10.12.2018, it was stated on behalf of defendant that an application for condonation of delay was filed on 22.10.2018 vide diary no.377108/2018 but said application was not on record. Learned counsel for defendant today submits that the same was returned under objection and now an application for condonation of delay in re-filing the said application is to be moved alongwith the said application. Let needful be done as stated within one week. Advance copy of the same be supplied to opposite side against due acknowledgment. Plaintiff is at liberty to file reply, if any, within three weeks after receipt of the copy of the application with copy to opposite side. Re-notify the matter for further proceedings on 07.03.2019.
