% 27.09.2016 Present contempt petition has been filed alleging wilful disobedience of the orders dated 19th May, 2014, 15th November, 2014 and 04th March, 2016 passed in Guardianship Suit No.41/2014 whereby the petitioner was permitted to meet the child on every fourth Saturday at 10:00 A.M. in the Children Room, Family Court (West) for a period of two hours. However, the custody of the child was granted to the mother.

Learned counsel for petitioner states that the respondent has been using the child as a tool to torture, harass and humiliate the petitioner and his family. He also states that various orders passed by the Family Court are not being complied with. In the opinion of this Court, the petitioner has an alternative effective remedy by filling an application under Section 43(4) of the Guardians and Wards Act, 1890.

Consequently, the present contempt petition and the application are dismissed with liberty to the petitioner to file the aforesaid alternative proceeding.
