Learned APP accepts notice on behalf of the State. The petition is a accused in case FIR No. 56/2010 under Sections 302/341/506/34 IPC registered at PS Mangol Puri, Delhi and is in judicial custody since 8th March, 2010. After prosecution witnesses were examined and the statement of the accused was recorded, since March, 2015 the matter was listed for final arguments before the learned Trial Court which concluded on 5th November, 2015 and parties were given permission to file the written submissions, if any, and the Court listed the matter for written submissions, if any,/final arguments on behalf of the prosecution on 24th November, 2015. Till date the judgment has not been pronounced. When the petitioner filed an application for grant of bail the same BAIL APPLN. 1953/2016
was dismissed by the learned Trial Court on 17th September, 2016 noting that the trial has reached fag end and is already fixed for final arguments. It appears that the learned Judge who heard the arguments finally on 5th November, 2015 has retired on 31st July, 2016. Obviously, now the Judge who takes over will have to hear the matter afresh. In view of the facts noted the learned Trial Court is requested to expedite the matter and after hearing the arguments, the judgment be pronounced preferably within a period of three months. Petition is disposed of.
