No ground for modification of the order dated 23.09.2016 is made out.

The application is accordingly dismissed.

Crl.M.A.No.16091/2016 in CRL.M.C. 3531/2016 This is an application under Section 482 Cr.P.C filed on behalf of the petitioner seeking liberty to withdraw the present petition.

Learned counsel for the petitioner submits that the SLP challenging the same order is pending before the Hon'ble Supreme Court of India and is listed for hearing today. He accordingly seeks leave to withdraw this petition.

In view of the submission made by counsel for the petitioner and the averments made in the application, the prayer is allowed and present petition and Crl.M.A.Nos.14927-14928/2016 are dismissed as withdrawn. Application stands disposed of.
