At the outset, counsel for the petitioner states that on perusing the counter affidavit filed by the respondents No.4 to 6, his client is satisfied and does not wish to press the present petition against the respondents No.1, 4, 5 and 7.

As for the remaining respondents, namely, respondents No.2, 3 and 6, counsel for the petitioner states that the present petition may be disposed of with liberty granted to the petitioner to approach the Armed Forces Tribunal for seeking relief against the Army with regard to payment of family pension before 23.09.2012.

Leave, as prayed for, is granted. The petition is disposed of alongwith the pending application.
