% 15.01.2018 It is submitted that in Crl. M. C. 687/2014 titled Jai Kishan Aggarwal and Others vs. State and Others, Crl. M. C. 4711/2014 titled R. U. K. Zuberi and Another vs. The State NCT of Delhi and Another and Crl. M. C. 1357/2015 titled Kapil Chugh vs. State and Another, FIR 5/2012 under Section 420/467/468/471/109/120-B IPC registered at Police Station EOW Cell was quashed in view of the compromise entered into between the petitioners in the said case and the respondent No. 2, Yes Bank Limited vide Memorandum of Understanding dated 20.11.2013, 25.04.2013 and 02.09.2013, respectively.
It is submitted that the petitioner is also one of the accused in the aforesaid FIR.
Petitioner has also entered into a Memorandum of Understanding dated 30.05.2014 with Yes Bank
Limited and has paid ` 60 lacs to the bank.
Counsel for the respondent No. 2 has not disputed this fact.
It is submitted that respondent No. 2 has settled the matter with the petitioner also and has received the settlement amount of ` 60 lacs. Respondent No. 2 has no objection in case FIR against the petitioner is quashed in the above facts.
In view of the facts and circumstances narrated above, FIR 5/2012 under Section 420/467/468/471/109/120-B IPC registered at Police Station EOW Cell is quashed against the petitioner as well. Petition is disposed of in the above terms.
