% 17.09.2018 There is no appearance on behalf of the petitioner on the matter being called out. The prayer in the petition filed under Section 439 (2) of the Code of Criminal Procedure, 1973 is for cancellation of bail of the second respondent in a case arising out of the FIR no. 261/2016 police station Paharganj under Sections 376/506 of IPC. The second respondent places on record copy of the judgment dated 13.08.2018 of the court of Sessions in case No. 16/2017 arising out of the said FIR whereby he has been acquitted. The petition, thus, is rendered infructuous and is dismissed accordingly.
