Pursuant to previous order dated 10th March 2026, Mr. Pankaj Seth, counsel for Insurance Company, seeks some time to obtain instructions from the Insurance Company regarding the calculation and the deposit. 2.

List on 27th April 2026 in Supplementary List. CM APPL. 14413/2026 (seeking release of 50% amount) 1.

This application has been filed seeking release of 50% of the enhanced compensation along with accrued interest.

Vide original award dated 2nd June 2016, MACT had granted compensation of Rs.10,55,000/- along with interest @ 9% from the date of filing of the claim petition till deposit. Court vide order dated 15th November 2025 by Rs.36,75,507/- along with interest at the rate of 9% p.a.

As per the original MACT award, considering, that the claimant was a minor at the relevant time, MACT had directed to deposit the said amount in a fixed deposit ('FD') to be released when the claimant attains the age of majority.

It has been contended that the claimant is now 17 years of age and his date of birth is 14th January 2009, therefore, he shall attain majority in another 8 months. It has further been contended that the claimant is a National Paralympic player (Javelin throw) and the family requires money for ensuring that his practice is up to the mark, so that he can bring laurels for the country. Except interest on FDs, the family has not been able to receive the benefit of compensation awarded, and they have spent a lot of money on medical treatment and purchase of prosthetics and other necessities for his upkeep; therefore, release of 50% enhanced compensation amount has been prayed. 5.

Considering these facts and circumstances and no objection on behalf of Mr. Pankaj Seth, counsel for Insurance Company, application is allowed. 6.

Accordingly, 50% of the enhanced compensation be released in favour of claimant within a period of two weeks by the Registrar General of this Court, 7.

Application stands disposed of.
