% 26.09.2016 Crl. M.A. No. 15153/2016 (Exemption) Allowed, subject to all just exceptions.
CRL.M.C. 3565/2016 The order dated 1st September, 2016 passed by the Maintenance Tribunal, North District has been challenged by Smt. Akanksha, daughterin-law of Pratap Singh and Saroj Devi, the petitioners before the Tribunal in whose favour the order was passed.
Admittedly, the petitioner is not the owner of the property bearing House No.38/15, Gali No.8, Gautam Colony, Safiabad Road, Narela, Delhi110040. Petitioner claims that her husband is the owner of the property. The record reveals that besides the husband of the petitioner, that is, Pushpendra, Saroj Devi is also the owner of the property. CRL.M.C. 3565/2016
Since the petitioner is not the owner of the property, she has no locus to challenge the order.
Petition is dismissed.
