% 02.05.2018 Counsel for the petitioner informs that an appeal against the order dated 23.03.2017 passed in OMP(Comm.) No.126/2017 is pending adjudication before the Division Bench of this Court in FAO(OS) (COMM.) No.113/2017. By its Order dated 4th September, 2017, the Division Bench of this Court has stayed the operation of the Arbitral Award subject to the respondent depositing the amount as directed therein.

In view of the pendency of the appeal and the order referred to above, counsel for the petitioner prays for leave to withdraw the present petition with liberty to file afresh in case need so arises after passing of the order by the Division Bench.

The petition is dismissed as withdrawn with liberty as prayed for.
