% 02.05.2016 I.A. No.5366/2016 By this application, the plaintiff wish to record the settlement arrived at with the defendants. The application is signed by the plaintiff and counsel for the plaintiff and is supported by the affidavit of Mr. Ramesh Chandra Agarwal, the partner of the plaintiff. Along with the application, the plaintiff has placed on record the memorandum of settlement arrived at with the defendant.

Learned counsel for the plaintiff states that an amount of Rs.27,20,000/- payable under the said settlement has already been received by them. Accordingly, the suit stands disposed of in view of the said settlement.

Since the suit has been settled prior the commencement of trial, the plaintiff shall be entitled to refund of 50% of the court fee. VIPIN SANGHI, J MAY 02, 2016 sr
