CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 30.09.2016 Marital discord between the husband and wife had led to registration of FIR No. 509/2014 at Police Station Pul Prahlad Pur against the husband and his family members under Sections 498-A/406/506/34 IPC on the complaint of wife. Petitioner no. 1 (husband) and respondent no. 2 (wife) have settled their disputes amicably in terms of the settlement. Their marriage has already been dissolved by a decree of divorce by mutual consent by the Family Courts on 26th August, 2016. Respondent no. 2 is present in Court and has been identified by SI Pankaj Kumar, P.S. Pul
Prahlad Pur.
She admits having received the entire settled amount and submits that she has no objection in case the present FIR is quashed. Keeping in mind that petitioner no. 1 and respondent no. 2 have decided to part ways and have, in fact, obtained a decree of divorce by mutual consent, no fruitful purpose would be served in keeping them entangled in the criminal proceedings.
Accordingly, in the interest of justice, FIR No. 509/2014 under Sections 498-A/406/506/34 IPC registered at Police Station Pul Prahlad Pur and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
