% 09.08.2017 Present matter has been listed before this Court in pursuance to the order dated 24th July, 2017 passed by the Joint Registrar as the plaintiff has neither filed the process fee nor deposited the cost imposed vide orders dated 12th January, 2017 and 01st May, 2017. The order dated 24th July, 2017 passed by the Joint Registrar is reproduced hereinbelow:- "The plaintiff has neither filed the process fee nor deposited the cost. Perusal of the record reveals that despite given several opportunities, the plaintiff has not taken the steps for service of the defendant. The cost imposed on 12.01.2017 and 01.05.2017 also not deposited. The matter be thus placed before the Hon'ble Court for further directions on 09.08.2017." In view of the aforesaid as well as the facts that none is present for the plaintiff even today, the present suit and pending application are dismissed in default and on account of non-prosecution.

The interim order dated 09th October, 2015 stands vacated. MANMOHAN, J AUGUST 09, 2017 js
