% 11.01.2018 The appellant filed a complaint being complaint case No.1074/1/02 under Section 138 of the Negotiable Instruments Act before the learned Metropolitan Magistrate. Vide the impugned judgment dated 12th December, 2014 the learned Metropolitan Magistrate acquitted the respondent. Hence the petitioner preferred a leave to appeal petition wherein leave was granted by this Court vide order dated 12th May, 2017. During the course of pending of the present appeal parties have entered into a settlement vide settlement dated 21st December, 2017 copy whereof has been placed on record. Learned counsel for the appellant states that the demand draft issued by the respondent in discharge of his full and final liability has since been encashed, therefore he does not press his present appeal.

Appeal is accordingly dismissed as withdrawn. The bail bond and surety bond filed by the respondent are discharged. MUKTA GUPTA, J.
