CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 20.05.2015 FIR No. 339/2006 under Sections 498-A/406/34 IPC was registered against the petitioner no.1 and his relatives, that is petitioner nos. 2 to 9 at police station Najafgarh, on the complaint of respondent no.2. Marital discord between the petitioner no.1 and respondent no.2 had led to registration of present FIR. Certain other proceedings were also initiated by the parties arising out of the matrimonial disputes. Now, petitioner no.1 and respondent no. 2 have settled their disputes amicably before the Mediation Centre, Dwarka. In terms of the settlement petitioner no.1 and respondent no. 2 have obtained a decree of divorce from the Family Court, Dwarka on 25th September, 2013. Respondent no.2 is

present in Court and admits that she has settled the matter with the petitioner no.1. She further admits that she has already received entire settled amount from petitioner no.1. She further submits that she has no objection in case the FIR is quashed.

Keeping in mind that parties have settled their disputes amicably and have already parted their ways in terms of the settlement, in my view, no fruitful purpose would be served in keeping them entangled in present criminal proceedings.

Accordingly, in the interest of justice, FIR No. 339/06 under Sections 498-A/406/34 IPC registered at police station Najafgarh and the consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of in the above terms. Dasti.
