% 12.01.2016 When the present petition came up for hearing on 5th December 2014, notices were directed to be issued to respondent No. 2 for 24th February 2015. As per office report petitioner had not taken steps to serve respondent No. 2 for 24.02.2015 as well as for 10.07.2015. On 10th July 2015, an adjournment was sought on behalf of the petitioner as the arguing counsel for petitioner was out of station and the matter was adjourned to 16.09.2015. On 16th November 2015 also, the petitioner sought an adjournment and the matter was accordingly adjourned to 16.11.2015.

None appeared on behalf of the petitioner on 16th November 2015 and even today, nobody is appearing on behalf of the petitioner. In view of the aforesaid facts and circumstances, it appears that the petitioner is not interested in prosecuting the present case. Accordingly, the present petition is dismissed for non-prosecution.
