ARB. A. (Comm.) 49/2018 This appeal has been filed under Section 37 of the Arbitration and Conciliation Act, 1996 challenging the Impugned Order dated 02.04.2018 passed by the Arbitral Tribunal adjudicating the disputes that have been arisen between the parties with respect to three Contracts, all dated 25.03.2005 in respect of Project or Facility of the appellant, for the execution of the Main Plant Package Part-1 (Steam Generator and Auxiliaries) for the appellant, NTTPC's Super Thermal Power Project (3X660 MW) at Barh, Bihar.

Having heard the counsel for the appellant, I see no ground to interfere with the Impugned Order, however, I clarify that the Arbitral

Tribunal will adjudicate the disputes pending before it, uninfluenced by any observations made by it in the said order or by the order passed in the present appeal today.

The petition is disposed of in the above terms, with no order as to cost.
