The present suit has been filed by the plaintiffs inter alia praying for a decree of partition of the suit property bearing No. H315, New Rajinder Nagar, New Delhi-110060. 3.

The defendant nos.2 to 9 have not filed their written statements and have not been appearing in the suit.

By an Order dated 21.05.2024, the parties, that are, the plaintiffs and the defendant no.1, were referred to the Delhi High Court Mediation and Conciliation Centre for exploring the possibility of arriving at an amicable settlement.

executed a Settlement Agreement dated 12.06.2024 before the Delhi High Court Mediation and Conciliation Centre. 6.

In terms of the said Settlement Agreement, the defendant no.1 had given two demand drafts mentioned in paragraph 7(i) and 7(ii) of the application to the plaintiffs.

The defendant no.1 today hands over the demand drafts mentioned in paragraph 7(iii) and 7(iv) to the plaintiffs, who are personally present in Court.

The plaintiffs affirm the terms of the settlement and submit that in terms of the same, they have also executed the Relinquishment Deed in favour of the defendant no.1, which has been duly registered on 25.06.2024, details whereof are mentioned in paragraph 8 of the application. They further declare and confirm that the defendant no.l is entitled to represent the estate of their deceased parents to the exclusion of the plaintiffs, as undertaken in the settlement. They pray for the disposal of the suit in terms of the said Settlement Agreement. 9.

The defendant no.1, who is also present in the Court, affirms the settlement.

The parties are identified by the counsels representing them in the suit.

I have perused the terms of the settlement and find the same to be lawful.

In view of the above, the plaintiffs pray for leave to withdraw the suit.

The application is allowed.
