% 26.10.2016 CO.APPL.4246/2016 The present application under Rule 9 of the Companies (Court) Rules, 1959 read with Section 151 of the Code of Civil Procedure, 1908 filed on behalf of the applicant-company in CO.APPL.(M) 142/2016 seeks permission of this Court to change the venue of the meetings of equity shareholders, secured creditors and unsecured creditors, of the applicant-company to be convened on 03.12.2016 at Shri Satya Sai Auditorium, Bhishm Pitamah Marg, Lodhi Road, New Delhi-110003 to Mirza Ghalib Chamber, Core-8, Scope Convention Centre-7, Scope Complex, Lodhi Road, New Delhi-110003.

Counsel appearing on behalf of the applicant-company states that the change of venue is dictated by the circumstance that the venue where the said meetings were originally scheduled to be conducted, as directed by this Court by way of order dated 07.10.2016, is unavailable. Counsel for the applicantcompany further undertakes to inform all the Chairpersons and Alternate Chairpersons, appointed by this Court, by way of order dated 07.10.2016, with regard to the changed venue, if and when they are granted permission to do so. In view of the foregoing, as well as, the facts averred in the application, which are duly supported by an affidavit, the same is allowed.

New Delhi-110003 to Mirza Ghalib Chamber, Core-8, Scope Convention Centre-7, Scope Complex, Lodhi Road, New Delhi-110003 and consequently, order dated 07.10.2016 is modified to the extent that venue of the meetings to be convened, is changed as directed. The applicant-company shall inform the Chairpersons and Alternate Chairpersons, appointed by this Court by way of order dated 07.10.2016 regarding the change of venue for the meetings directed to be convened by this Court vide the said order. The application is disposed of accordingly.
