O R D E R

% 10.07.2018 CM APPL.26872/2018 The present joint application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 has been instituted on behalf of the petitioners, as well as, respondent Nos.2 and 3 prays as follows:-

"It is, therefore, most respectfully prayed that the settlement/compromised arrived at between the parties be recorded and the Memorandum of Understanding & Settlement dt. 06.07.2018 be ordered to form part of the present application and the parties be directed to be bound by the terms of settlement/compromise, formed part of judicial record and the petition be disposed of accordingly. Any other or further order which this Hon'ble Court may deem fit and proper in the facts & circumstances may also be passed."

Learned counsel appearing on behalf of the parties, state in unison, that the underlying dispute that led to the institution of the present petition has been amicably settled by and between the parties and the terms and conditions of the settlement are enshrined in the Settlement Agreement/Memorandum of Understanding dated 06.07.2018 and the same is annexed as Annexure-'A' to the present application. The Settlement Agreement/Memorandum of Understanding dated 06.07.2018 entered into between the parties is lawful and the same is hereby accepted and taken on record.

The parties shall abide by the terms and conditions of the said Settlement Agreement/Memorandum of Understanding dated 06.07.2018 without demur.

The application is disposed of accordingly.

W.P.(C) 4305/2017 & CM APPL.18765/2017 In view of the settlement arrived at between the parties, as aforesaid, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition.

Leave granted.
