% 04.09.2017 It is submitted that petitioner is uncle of the prosecutrix as well as her husband.
There was marital discord between the prosecutrix and her husband and the complaint was pending before the CAW Cell. Petitioner used to accompany husband of the prosecutrix to the CAW Cell. Later on, petitioner was also implicated in the case.
During the pendency of bail application of husband of the prosecutrix, prosecutrix has settled the matter with her husband vide Memorandum of Settlement/Understanding dated 29th March, 2017. Reference of this settlement has also been made in the order dated 3rd July, 2017 passed by the Special Judge: PC Act (CBI)-09, Central, Tis Hazari Courts, Delhi, vide which bail was granted to the husband of prosecutrix. Prosecutrix is present in Court and has been identified by W/SI
Sumitra Devi of CAW Cell. She submits that she has no objection in case petitioner is granted anticipatory bail.
Keeping in mind totality of the facts and circumstances, of this case, it is ordered that in case of arrest petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of.
