CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 22.05.2015 Marital discord between the husband (petitioner) and wife (respondent no.2) had led to registration of FIR No. 385/2013 under Section 323/452/506/34 IPC at police station Jamia Nagar against the petitioner, on the complaint of respondent no.2. Respondent nos. 2 and 3 are present in Court.
They admit that disputes between the husband and wife have been resolved amicably and they have started living together. Respondent no. 2 confirms this fact. Memorandum of understanding dated 17th March, 2015 has been placed on record.
Respondent nos. 2 and 3 submit that they have no objection in case the FIR is quashed.
Keeping in mind that husband and wife have resolved their disputes amicably, in my view, no fruitful purpose would be served in keeping them entangled in present criminal proceedings. Accordingly, in the interest of justice, FIR No. 385/2013 under Section 323/452/506/34 IPC registered at police station Jamia Nagar and the consequent proceedings emanating therefrom are quashed.
Writ petition is disposed of in the above terms. Dasti.
