% 03.03.2016 This matter has been listed before this Court in view of the noting dated February 26, 2016 of the Registry for listing the case today. In terms of the order dated December 14, 2015, IA 16721/2015 filed by the plaintiff under Order 9 Rule 9 CPC for setting aside the order dated May 21, 2015 was dismissed. The said order was challenged by the plaintiff in FAO(OS) 659/2015, which was decided by the Appellate Court on February 15, 2016, whereby the Appellate Court had allowed the appeal and restored the present suit for adjudication on merits. Learned counsel for the parties state that the suit is for declaration and its valuation is Rs.28,00,330/-.

In view of Notification No. 27187/DHC/Orgl. dated 24th November, 2015 & in exercise of power conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, (Act 23 of 2015), which came into force with effect from 26th October, 2015 vide Notification No. F.No.L19015/04/2012-Jus dated 26th October, 2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs published in Gazette of India Extraordinary, Part II, Section 3 Sub-Section (ii), the present matter is liable to be transferred to the learned District & Sessions Judge, South West District, Dwarka Courts, Delhi. Accordingly, the parties to appear before the learned District & Sessions Judge, South West District, Dwarka Courts, Delhi on April 18, 2016.
