% 03.05.2018 The present revision petition was filed to challenge the order dated 10.02.2015 of the trial court whereby the application of the respondent under Order IX Rule 13 of the Code of Civil Procedure, 1908 was allowed and the proceedings in the civil suit (suit no. 76/2010) by the petitioner on 28.01.2010 were revived giving renewed opportunity to the respondent/defendant to contest.
The counsel for the petitioner submits that he may be permitted to withdraw the present petition and the application filed therewith, his only request is that since the suit is quite old, the matter having been held up because of the pendency of this revision petition, directions may be given to the trial court for expeditious disposal preferably within six months hereof. The counsel for the respondent/defendant who is present agrees to directions C.R.P. 82/2015
to above effect being issued indicating that he would cooperate in the expeditious proceedings.
The petition and the application filed therewith are dismissed as withdrawn. The learned trial court is directed to proceed with the trial expeditiously and make all endeavour to render its decision at an early date. R.K.GAUBA, J MAY 03, 2018 nk C.R.P. 82/2015
