W.P.(CRL) 1484/2017 The First Information Report (FIR) No.7/2016 was registered on 22.01.2016 at the instance of the second respondent alleging offences punishable under Sections 406/420/120-B/34 of Indian Penal Code, 1860 (IPC) of Police Station Crime Branch. As per the case set up in the FIR the petitioner with some of his associates had persuaded the second respondent (the first informant) to pay Rs.11 lacs for arranging admission in a medical college for his daughter, she being a candidate in the entrance test (AIPMT) for such purpose. The petitioner prays for quashing of the FIR on the ground that the matter has been amicably settled with the first informant. W.P.(CRL) 1484/2017

Given the background facts noted above, this is not an ordinary run of the mill case of cheating or misappropriation of money or one arising out of civil transaction. The background facts reveal possibility of an illicit network organized by the petitioner and his associates for arranging admissions in medical colleges for unlawful gratification collected from gullible people at large. Therefore, the case involves larger public interest rather than a private dispute.

In these circumstances, prayer for quashing is declined. Dismissed.
