The learned counsel appearing for the Institute of Chartered Accountants of India (ICAI) submits that subsequent to the decision of the ICAI recommending that the petitioner's name be removed from the Register for a period of three months, the ICAI has already filed a reference before the Division Bench of this Court captioned Council of The Institute of Chartered Accounts of India v. Shri S.N. Shivakumar : CHAT. A. REF 1/2018. It is stated that notice in the said reference was issued on 30.05.2018 and the petitioner has also sought time to file his response to the same.

In view of the above, the petitioner seeks to withdraw the present petition by reserving all the rights and contentions.

The petition is dismissed as withdrawn with the aforesaid liberty. 4.

The pending applications stand disposed of.
