Accordingly, suit is disposed of qua the defendant no.1 as not pressed. As regards plaintiff and the defendant no.2 are concerned, they have settled their disputes on the terms and conditions as stipulated in this application which has been signed by the plaintiff and the defendant no.2 as well as their counsel, inasmuch as has been supported by the affidavit of authorized representative of the plaintiff and the defendant no.2. Parties shall remain bound by the terms of settlement. Application is marked as 'Mark C1'. I do not find the terms of settlement to be in conflict with any law. Suit is decreed in terms of the 'Mark C-1', which shall form part of decree. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
