% 17.01.2018 Present suit has been filed for permanent injunction restraining the violation and infringement of rights in the registered trademarks 'MONICA GOLD' and 'MMP (LOGO)', damages, rendition of accounts and delivery up.

Learned counsel for the defendant states that the defendant has no objection if the present suit is decreed in accordance with prayer (A) of the present plaint. He further states that the goods seized by the Local Commissioner shall be disposed of/destroyed in the presence of an authorized representative of the plaintiff. In view of the aforesaid statements, learned counsel for the plaintiff does not wish to press for any other relief. The statements made by both the counsel are accepted by this Court and the parties are held bound by the same.

Consequently, the suit is decreed in terms of the aforesaid statements. Registry is directed to prepare a decree sheet accordingly. For the purpose of disposing of/destroying the seized goods, the authorized representative of the plaintiff is directed to visit the defendant's premises on 29th January, 2018 at 11.00 A.M.
