% 26.09.2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 5th August, 2016 passed by a Coordinate Bench of this Court in W.P.(C) No.6807/2016, whereby the respondents were directed not to disturb the status of building bearing no. 2292-2336, Peeli Building, Arya Samaj, Karol Bagh, New Delhi as the same is in a dangerous and dilapidated condition. The respondents were also directed not to undertake any encroachment/additional construction except what was necessitated in view of the monsoon season.

Learned counsel for the petitioner states that despite the

specific directions of this Court, respondent no. 1 has disturbed the status of the building in question and has carried out further construction.

Learned counsel for North DMC who appears on advance notice states that fresh construction/repairs have been noticed by the officials of North DMC and appropriate order/action shall be taken within the stipulated period of eight weeks granted by this Court on 5th August, 2016.

In view of the said statement, learned counsel for the petitioner does not wish to press the present contempt petition any further. Consequently, the present contempt petition is closed. However, it is clarified that the respondent-North DMC is held bound by the aforesaid statement/undertaking given to this Court. MANMOHAN, J SEPTEMBER 26, 2016 KA
