Since the CM(M)330/2017, which was listed at item no.54 today, has been disposed of and the amendment has been allowed by this Court, learned counsel for the parties submit that they shall request learned trial Court to dispose of the matter expeditiously by giving short dates. 2.

Learned counsel for the respondent submits that respondent will fully cooperate in speedy disposal of the suit which also involves the counter claim filed by him and it is in the interest of both the parties that the trial in respect of the suit as well as the counter claim is expedited. 3.

In view of the assurance being given by the learned counsel for the respondent, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to approach learned trial Court for speedy disposal. 4.

The petition is dismissed as withdrawn granting the liberty as prayed for.
