% 28.09.2016 1.

Execution is sought of a decree dated 18th May, 2015 for recovery of Rs.20,87,500/- with interest by attachment of movable and immovable properties of the judgment-debtor at Mumbai.

2.

Though the execution should have been filed before the Court of the District Judge but since the execution is sought by attachment and sale of the movable and immovable properties of the judgment-debtor at Mumbai, it has been enquired from the counsel for the decree-holder as to why the prayer for transfer of the decree to Mumbai has not been sought. 3.

The counsel for the decree-holder states that erroneously the said prayer was not made and the requisite amends will be made. 4.

Accepting the oral request of the counsel for the decree-holder, the execution petition is disposed of by directing the transfer of the decree for execution to the City Civil Court, Mumbai as sought. 5.

The transfer certificate and ancillary documents be supplied to the counsel for the decree-holder.
