Learned counsel for the respondent who appears on the advance notice states that the order of remand may be passed as the impugned order dated 15th February, 2017 requires reconsideration in view of the judgment of the Supreme Court in Mahinder Dutt Sharma vs. UOI and Ors. 2014 (3) 278All India Services Law Journal and decision of this Court in WP (C) No.5544/2007 Ex.ASI Shadi Ram vs. Government of NCT of Delhi and Ors. decided on 22nd February, 2008.

In view of the statement made, the impugned order is set aside with direction that the respondent shall reconsider the request of compassionate allowance and pass a fresh speaking order within three months. We clarify that we are not expressing any opinion on merits.
