% 31.08.2018 Learned counsel appearing on behalf of School of Planning & Architecture/respondent No. 2 states that although, a seat is lying unfilled with their institution, the same cannot be allotted to the petitioner, in view of the circumstance that the Hon'ble Supreme Court vide its judgment and order dated 13.12.2012 in Civil Appeal No. 9048/2012 titled as "Parshavanath Charitable Trust & Ors. Vs. All India Council for Tech. Edu & Ors. and in Civil Appeal No. 9047/2012 titled as "Chetan Pathare & Anr. Vs. All India Council for Technical Education & Ors. has observed as follows:- "All seats should be filled positively by 15th August after which there shall be no admission, whatever be the reason or ground." In view of the foregoing, Mr. Tarun Sharma, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition.
Leave granted.
The petition is dismissed as withdrawn and disposed of accordingly.
Pending application also stands disposed of.
A copy of this order be given dasti under the signatures of Court Master.
