W.P.(C) 8570/2016 & C.M. No.35323/2016 Petitioner is Usha Rani. She is stated to be the widow of Late Bansi Lal. It is stated that Bansi Lal was originally operating from a site near Sewa Nagar Market, Opposite CGHS Dispensary near Satsang Park, New Delhi. After his death (16.8.2010) his widow has been operating from the said site. It is stated that this is the only source of livelihood of the petitioner and her family. The challans in support of her stand are of February, 2016. Submission of the
petitioner is that she is adequately protected under Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.
Per contra, learned counsel for the respondent submits that these challans do not create any vested right in favour of the petitioner.
Be that as it may, noting the above factual position. This Court is of the view that this petition can be dispose of with liberty granted to the petitioner to approach the Town Vending Committee of the South Delhi Municipal Corporation as and when it is constituted. Accordingly, Petitioner is granted liberty to approach the concerned TVC to get addressed his grievance.
No further orders are called for in this petition. Petition disposed of.
