The status report has been filed by SDMC. Paras 3 to 5 of the same read as under:- "3.
That it is further submitted that in order to execute the demolition/sealing orders in respect of the subject property the department fixed the sealing/demolition action for 09/11/2017 and vide same upon availability of police force has taken the following demolition/sealing actions:- S.No.
Date of Action Action taken 09/11/2017 During the course of demolition action taken at Fourth floor 01 RCC panel cut down and property sealed at Third floor and Fourth floor 02 points at Third floor and 02 points at Fourth floor. The photographs taken during the course of action are annexed herewith in this regard as Annexure R-1/A (Colly).

That subsequently, after taking the aforesaid demolition/sealing actions a letter bearing No. D2438/BldgI/SZ/2017 dated 13/11/2017 has also been sent to SHO, concerned, PS Malviya Nagar with the request to instruct the partrolling staff to keep strict vigil over the subject property so that the sealed affixed be not tempered with. The copy of the said letter is also annexed herewith as Annexure R-1/B. 5.
That moreover, it is also submitted that the department has now fixed the further demolition /sealing action for 16/01/2018 which will be taken/carried out upon availability of police force."

In view of the fact that a further demolition action is fixed on 16th January, 2018 and it is expected that the respondent shall carry out the demolition on the said date, the petition is closed with liberty to the petitioner to revive the same, if there is inaction on the part of the SDMC in demolishing the property to the satisfaction of the petitioner. 3.
Petition stands disposed of.
