% 05.09.2018 By these petitions under Section 482 of the Code of Criminal Procedure, 1973, it has been prayed that following cross FIRs may be quashed :-
(i) FIR No. 131/2012 under Sections 325 IPC registered at police station GTB Enclave on the complaint of Raj Kumar (respondent no.2 in Crl. M.C. 4429/2018 and petitioner no.1. in Crl. M.C. 4411/2018) (ii) FIR No. 184/2012 under Sections 323/341/308/452/34 IPC registered at police station GTB Enclave on the complaint of Dharmender (respondent no.3 in Crl. M.C. 4411/2018 and petitioner no.1. in Crl. M.C. 4429/2018). Raj Kumar and Dharmender (complainants) are present in Court along with their respective counsel. They have been identified by ASI Hukum Chand of police station GTB Enclave. They submit that they have settled the matter with each other of their own free will and without any undue force, pressure or coercion. They have no objection in case the aforesaid cross FIRs and the consequent proceedings are quashed.
Keeping in mind the settlement arrived at between the accused persons and complainants voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid cross FIRs and the consequent proceedings emanating therefrom are quashed.
Both the petitions are disposed of in the above terms. Dasti.
