% 18.10.2016 Status report has been filed. It is pointed out by the State that the International Mobile Equipment Identity (IMEI) Number provided by the petitioner, of the mobile phone instrument which she alleges to have been stolen, has been tracked and it is found that the same is, in fact, used by the petitioner's sister in Mumbai and the petitioner is also having communications with her sister on the said mobile phone instrument. The petitioner, who appears in person, states that the stolen mobile phone instrument was red coloured Nokia mobile phone instrument, which is also seen in possession of the petitioner in the CCTV footage of the hotel.
She submits that the said mobile phone instrument had been gifted to her by her sister and it could be that the sister may have provided the IMEI Number of a different mobile phone instrument and not the instrument that was gifted by her to the petitioner. She states that she would check up and provide the correct IMEI Number to the I.O. Here itself I may note that in her petition, the petitioner claims that she had two mobile instruments when she had gone to the hotel - one of Samsung brand and the other of Xoami brand. At that stage, she had not claimed that she was possessed of a mobile instrument of Nokia brand.
In any case, if the petitioner provides the correct IMEI Number of the stolen mobile phone instrument, the I.O. shall carry out investigation in that respect and track the same.
The petitioner has preferred this petition for conduct of effective investigation in the FIR in question being FIR No.260/2016 dated 08.09.2016 registered at PS - e-Police Station, District - Crime Branch, Delhi. In view of the status report, it cannot be said that the police has not carried out the investigation thus far in an effective and honest manner. It is hoped that the investigation shall be carried out in future as well equally effectively. The other reliefs sought in the petition are not maintainable.
