% 12.02.2018 IA No. 1937/2018 Learned counsel appearing for the plaintiff has filed this application under Order 23 Rule 1 CPC seeking withdrawal of the suit. Learned counsel appearing for the defendant submits that she has no objection to the application. She also submits that she has filed a counter claim which she would also like to withdraw.

The application is allowed.

CS(OS) 238/2017 and IA No. 11415/2017 Suit and the count claim are dismissed as withdrawn. As the proceedings are at an initial stage, in terms of the Court Fees Act, the parties shall be entitled to refund of 50% of their court fees respectively.
