W.P.(C) 9096/2016 & CM No.36844/2016(interim relief) Petitioner impugns some questions and their answers and seeks reconsideration of the model answer key for National Eligibility - cum - Entrance Test -NEET (UG) 2016 examination and to grant fresh marks and ranking to the petitioner. It is contended that the answer key in respect of question Nos.161, 170 and 174 is incorrect.
By judgment dated 23.09.2016 in W.P.(C) No.7750/2016 titled Sagar Sanjeev Dua versus Central Board of Secondary Education & Others, this Court has already held that this Court, in exercise of powers under WP(C) 9096/2016
Article 226 of the Constitution of India, cannot take over the task of correcting the answers set in answer key framed thereto by an independent subject expert. The case of the petitioner is squarely covered by the said judgment.
In view of the judgment in the case of Sagar Sanjeev Dua (Supra) , I find no merit in the petition. The same is accordingly dismissed. SANJEEV SACHDEVA, J OCTOBER 04, 2016 'sn'
