% 02.12.2016 By way of order dated 3rd October 2016, the parties to the present winding up petition had been referred to the Delhi High Court Mediation and Conciliation Centre.

The report of the Mediator is on record.

The parties to the winding up petition have arrived at an amicable resolution of the underlying dispute by a settlement agreement dated 25th November 2016, which is annexed to the report of the Mediator. The settlement arrived at between the parties is lawful.

The parties are now directed to comply with their reciprocal agreement in terms of the said agreement date 25th November 2016, without demur.

In view of the foregoing, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition at this juncture, with liberty

to revive the same in the event the said settlement agreement dated 25th November 2016 is not complied with by the respondent company. Leave and liberty granted.
