% 01.10.2018 By this petition, the petitioner seeks anticipatory bail in case FIR No. RC 17(A)/2018 DLI under Sections 120-B/420/511 IPC registered by the CBI.
As per the status report filed, the above mentioned FIR was registered against Mohit Kumar @ Mohit Chaudhary, Manoj Kumar Sikka, Ashwani Tomar and the petitioner-Arti Tomar of M/s Akruti Education and unknown candidates/parents and other private persons under Section 120B read with Section 511 read with Section 420 IPC on the written complaint by one Sanyam Bhardwaj, Director, NEET, CBSE, Shiksha Kendra, Preet Vihar, Delhi.
As per the case of the prosecution, one Mohit Kumar was found to be acting as a tout and helping/storing/alluring the prospective students and
their parents for qualifying in the NEET Exam and for securing admissions in various Government and private colleges across India. Though the entire status report says that the petitioner was hand-inglove with the other co-accused but there is no attempt made to show what was the specific role assigned to the petitioner. Petitioner has a one year old daughter to look after. Considering the facts noted above, this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that in case of change of address, the same will be intimated to the Court concerned by filing an affidavit and the petitioner will not leave the country without prior permission of the Court concerned.
Petition is disposed of. Order dasti.
