This is an application filed under Section 340 Cr.P.C. on behalf of the respondent No.2.

Learned counsel for the respondent No.2/applicant submits that facts mentioned in this application are same as mentioned in contempt petition being Cont.Cas(C) 808/2015, which is also listed today at item No.7. 3.

Learned counsel for the respondent No.2/applicant submits that applicant wants to continue with the contempt petition and this application may be dismissed as not pressed.

In view of the above, the application is dismissed as not pressed.

By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 of Cr.P.C., petitioner is praying for quashing of the FIR No. 148/2015 registered under Sections 120-B/420/406 IPC at PS Anand Vihar.

Today Mr.Ajay Burman, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to avail the remedy as per the law at the appropriate stage.

The writ petition is dismissed as withdrawn granting the liberty as prayed.
