O R D E R

% 04.09.2018 The petitioner herein is the married sister of Amar Kumar Pandey whose wife Lovli Kumari died on 06.07.2018. It appears that the deceased was taken to the hospital by her husband where she was declared brought dead. It does appear as a highly incriminating circumstance that she was married to Amar Kumar Pandey only on 11.05.2018 but the cause of death is not yet ascertained. The father of the deceased, while lodging the FIR, has suspected foul play, in his opinion, the death being homicidal. The petitioner being married was apparently living in a separate house in a different locality.

Though, allegations have been made also against her respecting the demand of Rs.3,00,000/, such allegations, prima facie, appear to be omnibus and by including all possible relatives of Amar Kumar Pandey. There is no allegation of the petitioner being present around the time the victim suffered causes that may have resulted in her death. BAIL APPLN. 2056/2018

Having regard to these facts, the prayer is granted. The petitioner is directed that in the event of the she being arrested, she shall be released on bail by the arresting officer on furnishing personal bond in the sum of Rs.20,000/- with one surety in the like amount subject to the following further conditions:- (i) The petitioner shall continue cooperating with the investigation and join the same as and when called upon to do so; (ii) The petitioner shall not come in contact with or try to influence any of the witnesses connected to the case;

(iii) Prior to her release, she shall give the telephone numbers of self and of at least one other responsible family member besides that of the surety to the investigating officer;

(iv) She shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer or tamper with the evidence;
