O R D E R

% 05.12.2016 The learned counsel appearing for the petitioner, on instructions from the petitioner who is present in person, states that he undertakes on behalf of the petitioner to vacate the tenanted premises/property in question, comprising two rooms and covered verandah on the ground floor of property No.7784, Arakashan Road, Ram Nagar, Paharganj, New Delhi- 110 055 as described by the respondent in the eviction petition and hand over vacant physical possession of the same on or before two years from today, i.e. on or before 04.12.2018 to the respondent. He submits that he shall file an affidavit of undertaking on behalf of the petitioner within two weeks from today. He submits that the petitioner shall not part with possession of the property or cause any wilful damage to the property. He submit that during

the period the property is in petitioner's occupation, she shall continue to pay agreed rent of Rs.25.00 per month, electricity and water charges of the property to the respondent.

The learned counsel appearing for the petitioner further submits that in view of the above, the petitioner does not want to press the present petition.

The learned counsel appearing for the respondent, on instructions from the respondent who is present in person, states that the respondent shall not execute the eviction order till 04.12.2018. Keeping in view the above, the present petition is disposed of. All the pending applications also are disposed of.
